The attorney representing the state who pursues criminal charges against the defendant.
“if you're in a courtroom and you're negotiating with a prosecutor you can do that but there are a lot of things that may happen that you may not be aware of or know to look for and unfortunately even though there's a whole lot of information on the internet the internet does not have all of the knowledge and it doesn't have it all correct”
“First, and this is huge, don't talk about your case with anyone except your attorney. I mean it. Don't discuss it with family, friends, co-workers, or anyone you meet socially. Don't post about it online or in forums. And don't even make casual comments in passing. Something like, "I only had two beers," or, "The officer was a jerk," can often will be used against you. Prosecutors love finding inconsistencies between what you told police, what you told friends, and what you claim at court. So, keep quiet. The fewer people who know, the better.”
“The third mistake I often see is defendants trying to explain themselves to the prosecutor. If I just explain the situation, everything will be fine. Maybe I wasn't really that drunk. Maybe it was a medical emergency. Maybe the officer made a mistake. Don't do it. Don't contact the prosecutor directly. Anything you say can and will be used against you. Let your attorney handle all communications with the prosecution. That's exactly what we're here for.”
