The short answer is yes, domestic violence enhancements are a deportable offense, and you can be deported and most likely will be deported if you get a conviction for domestic violence.”
“There are a couple of ways that you can address this to hopefully avoid that deportation process being triggered. But quite frankly, the only way that you're going to avoid deportation is if you are able to have an attorney negotiate on your behalf to have you plead to a non deportable offense. In other words, a non-domestic violence offense, it also has to be an offense that does not contain a knowing or reckless component.”
“But if you have even a deferred sentence for domestic violence, because you have that plea of guilty that can trigger deportation.”
“So the issue is, if you are not a legal US resident or a citizen, you must get an experienced attorney on your side if you're facing criminal charges for domestic violence. Because if you're not careful pleading to something that normally would sound good to a citizen, for example, a deferred sentence where after a term of time you can actually get the case dismissed, impacts people with immigration consequences very differently.”
